The English translation of these Terms and Conditions is provided for information purposes only. In the event of any discrepancy, the French version (Conditions Générales de Services) shall prevail.
Article 1 – Purpose
These Terms and Conditions of Service set out the terms governing the support provided to the Client by Quinta Essentia SASU.
Article 2 – Nature of the Support Provided
The support provided by Quinta Essentia falls within the fields of personal support, wellbeing and coaching. It may be provided to an individual, a couple, a family, a group or in any other support format suited to the request and to the professional competencies of the hypnotherapist/NMO-EMDR & Reiki practitioner.
As the professions of hypnotherapist and NMO-EMDR & Reiki practitioner are not regulated in France, this work is provided exclusively as personal or corporate support. Depending on the circumstances, it may be provided independently or alongside medical, paramedical or psychological care, but never as a substitute for such care, including diagnosis, prescribed treatment, psychiatric care or psychotherapy.
Clients are encouraged to inform their treating doctor or any healthcare professional involved in their care if they wish to begin hypnotherapy, NMO-EMDR or Reiki support alongside medical treatment or therapeutic care. The hypnotherapist/NMO-EMDR & Reiki practitioner does not perform medical acts, make diagnoses or request that ongoing medical treatment be stopped or changed.
Article 3 – Mutual Commitments and Informed Consent
The relationship between the hypnotherapist/NMO-EMDR & Reiki practitioner and the Client is based on trust, mutual respect, courtesy, kindness, confidentiality and respect for the dignity of each person. Members of the National Union of Hypnotherapists (SNH) undertake to uphold these fundamental principles in their professional practice in order to ensure support that respects the individual and promotes a constructive therapeutic relationship.
I undertake to use all means within my professional competence to provide support in accordance with the ethical and professional principles of my profession. My commitment is an obligation of best endeavours and not an obligation to achieve a specific result.
The Client remains free in their choices, decisions and actions. The Client remains fully responsible for implementing them and undertakes to provide the information necessary for the proper conduct of the support provided, as well as to behave respectfully towards the hypnotherapist/NMO-EMDR & Reiki practitioner.
I answer the Client’s questions concerning their support and ensure that their free and informed consent is obtained before any intervention. The Client acknowledges that they have been informed of the nature, objectives, methods and limitations of the support offered by Quinta Essentia. The Client remains free to accept, refuse or discontinue the proposed sessions at any time.
Article 4 – Referral to Other Professionals and Limits of Intervention
I reserve the right to refuse, suspend or discontinue support where I consider that the request made or the situation presented falls outside my area of competence or exceeds the limits of my professional intervention.
In the Client’s best interests, I may refer them to a healthcare professional or any other qualified professional where the situation requires it. I also reserve the right not to begin or continue support where I consider that the conditions of safety, trust or cooperation required for appropriate work are not present.
Article 5 – Support for Minors
Support for a minor requires the consent of their legal representative(s). I reserve the right to request written authorisation and the presence of a parent or legal representative during all or part of the sessions, depending on the minor’s age, maturity and the nature of the support requested.
I remain free to refuse or discontinue support if I consider it unsuitable for the minor’s situation or outside my area of competence.
Article 6 – Appointments, Cancellations and Late Arrivals
Unless otherwise agreed or in the event of force majeure, any session cancelled less than 48 business hours before the appointment may be charged at the full rate of the booked session.
In the event of a late arrival by the Client, the duration of the session may be reduced in order not to delay subsequent appointments, or the session may be rescheduled.
Article 7 – Fees and Payment
The applicable fees are those displayed at the practice and published on the Quinta Essentia website: quinta-essentia005.com.
Accepted payment methods are those indicated on the website of the hypnotherapist/NMO-EMDR & Reiki practitioner and displayed at the practice. Payment for sessions is due before or at the end of each session. A deposit may be requested before the appointment.
Article 8 – Remote Sessions, Intellectual Property and Recordings
Where sessions are held remotely, by video consultation or any other means of communication, each party undertakes to ensure an environment that safeguards the confidentiality of the exchanges and to have the technical means required for the session to proceed properly.
The hypnotherapist/NMO-EMDR & Reiki practitioner cannot be held liable for interruption or poor quality of a session resulting from an Internet network failure, computer outage, equipment malfunction or any other technical event beyond their control. In the event of an incident, the parties will agree, where possible, on how the session will continue or be rescheduled.
Any materials provided or sent to the Client as part of the support, including audio recordings, exercises, practical worksheets, scripts, documents, videos or any other educational content, remain the intellectual property of their author. They are intended exclusively for the Client’s personal and private use.
Any reproduction, distribution, disclosure to third parties, modification, publication, commercialisation or use, in whole or in part, for professional, commercial or training purposes is prohibited without my prior written authorisation.
No audio, video or photographic recording of sessions, whether held in person or remotely, may be made by either party without their prior, express and mutual consent.
Article 9 – Confidentiality, Ethics and Professional Conduct
Exchanges with Clients and individuals receiving support are confidential, subject to applicable legal obligations. I undertake to respect their privacy, dignity, beliefs, values and autonomy.
As a member of the National Union of Hypnotherapists (SNH), I am a signatory to the SNH Ethical and Quality Charter and its Code of Professional Conduct. I undertake to respect their principles in my professional practice. These documents may be consulted on the SNH website: www.snhypnose.fr.
Article 10 – Professional Indemnity Insurance
I confirm that I hold professional indemnity insurance covering the conduct of my professional activity.
Article 11 – Protection of Personal Data (GDPR)
The information collected when booking appointments and during the support provided is used solely within the scope of my professional practice as a hypnotherapist and NMO-EMDR & Reiki practitioner.
In accordance with the General Data Protection Regulation (GDPR), every person has the right to access, rectify, restrict or erase their personal data. Any request may be sent directly to me.
Article 12 – Applicable Law and Dispute Resolution
These Terms and Conditions of Service are governed by French law.
In the event of a dispute, the parties will endeavour to find an amicable solution. Failing an amicable agreement and, where applicable, after referral to a consumer mediator, the dispute will be brought before the competent courts in accordance with the legal provisions in force.
The Client may bring proceedings before the court of the place where the professional practises, in accordance with the applicable rules.
